Yoga with Grace Declaration and Liability Waiver
I agree that Yoga with Grace is in no way responsible for the safekeeping of my personal belongings while I attend class. I understand that classes at Yoga with Grace may be physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
I declare that I am and must continue to be medically and physically fit and able to participate in the classes offered at Yoga with Grace. I understand and accept that Yoga with Grace will continue to rely on this declaration as evidence of my fitness and ability to participate. It is my responsibility to notify the teachers at Yoga with Grace of any issues that may impact my practice at Yoga with Grace. I understand that Yoga with Grace, its teachers shall be neither liable nor responsible for any loss or injury caused directly or indirectly within the Yoga with Grace studio or online classes.
Terms and Conditions
- Please choose carefully as there are no refunds provided on any of our real life or zoom class packages
- All of our class packages are valid for the length of time stated and cannot be extended or refunded for any reason.
These terms and conditions are not negotiable.
Account Requirements: You agree to use the Website only for the purposes that are permitted by the Terms and any valid and applicable law, regulation or generally accepted practices in the relevant jurisdictions. You are responsible for maintaining the confidentiality of your Registration Data, and you are responsible for all activities that occur under your username or account. If you discover or suspect any unauthorized use of your account, you agree to immediately notify Yoga with Grace. Yoga with Grace may terminate any account that is inactive for an extended period of time, or for any reason at all, in its sole discretion.
Disclosure of Account Information: You acknowledge and agree that Yoga with Grace may access, preserve and disclose your account information or Registration Data if required to do so by law or if such access, preservation or disclosure is necessary to: (a) comply with legal process; (b) enforce the Terms; (c) respond to your requests for customer service; or (e) protect the rights, property or safety of Yoga with Grace anyone else.
Refund Policy: Some paid courses (clearly stated) accessible via Website come with a 30-day refund policy. In order to request a refund, you must be able to demonstrate your participation and application of the principles taught within the course. The refund request must be made within a 30-day period after the purchase, and the request shall be sent to info@yogawithgrace.com.au and the refund request must demonstrate that you have applied the principles taught within the course, and state the reason for your dissatisfaction. Any refund request submitted later than the 30-day period after the purchase will be rejected.
Prohibited Conduct.
You agree that you will not:
• Engage in any activity that interferes with or disrupts the website, the services or the servers and networks which are connected to the services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services;
• Use the Services for any fraudulent or illegal purpose, or to gather personally identifiable information without prior consent;
• Post any content, or link to any website, containing any obscene, violent, illegal or objectionable material; or
• reproduce, duplicate, copy, sell, trade or resell the Services for any purpose; or
• distribute software viruses on the Website; or
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity, during registration or otherwise.
Termination:
The Terms will continue to apply until terminated by either you or Yoga with Grace. If you want to terminate your legal agreement with Yoga with Grace, you may do so by: (i) notifying Yoga with Grace at any time by sending a written notice to info@yogawithgrace.com.au (The notice shall clearly state your will to terminate the agreement); – Yoga with Grace may terminate this agreement with you at any time, in its sole discretion, and with or without prior notice, including (but not limited to) if: (i) you have breached any provision of the Terms; (ii) Yoga with Grace is required to do so by law; or (iii) the Services are modified, eliminated, or no longer commercially viable.
Illegal Conduct: Yoga with Grace reserves the right, in its sole discretion, with or without notice, to investigate, and to involve and cooperate with law enforcement authorities, and to pursue a civil lawsuit or criminal prosecution for any alleged or actual illegal activities involving the services or use of the services or the website.
Intellectual Property: You understand that all information or materials to which you may have access as part of, or through your use of, the services or the website is the sole responsibility of the person from which such information or materials originated. All such information is referred to as “Content.” All such Content, including but not limited to advertisements, logos, sponsored Content, posts, blogs, messages, and third-party links on the website, may be protected by intellectual property rights which are owned by the provider of the Content (or by other persons or entities). You may not modify, rent, lease, loan, sell, distribute, copy, or create derivative works based on this Content (either in whole or in part) unless you have been given written permission by the owners of that Content. You acknowledge and agree that: (i) Yoga with Grace (or its licensors) owns all legal right, title and interest in and to the services and to the Content created by Yoga with Grace, including any intellectual property rights which subsist in the Services (whether those rights happen to be registered or not, and wherever in the world those rights might exist); (ii) by posting any Content, you grant an irrevocable, non-exclusive, royalty-free license to Yoga with Grace to use, reproduce, modify, and redistribute such Content alone, as a party of the Services, or as a part of other works in any form chosen in Yoga with Grace sole discretion; and (iii) that Yoga with Grace is in no way responsible for, nor shall have any liability related to, any Content which is not created by Yoga with Grace. The trademarks, service marks, and trade names appearing on the Website are the common law or registered trademarks of Yoga with Grace, its licensors, or others. No trademark, service mark, or trade name may be used without the express written permission of the owner.
